Is it legal for somebody to drive a vehicle on private property (eg the parking area of a residential complex) if they are underage (younger than
18) and do not have a driver's licence?

Answer: |
A road that is used by other members of the public is not deemed to be a private road even if that road is in a residential complex. It is therefore a requirement to be fully licensed to operate that vehicle or if possession of a learner's licence to be accompanied by a fully licensed person.

We have a 12-seater minibus at our school. We transport learners to sports events and other functions. We do not charge any money for using the minibus. Do the educators need a special licence to drive the vehicle?

Answer: |
The regulations states the driver of a vehicle designed to convey 12 or more persons (including the driver) must be in possession of a valid professional driving permit (PrDP)for category P. So your educators need a PrDP.
Remember even if the driver is alone he or she has to have a PrDP as the regulation states 'designed to carry'.

Answer: |
A learner driver must be accompanied by a licensed driver. The licensed driver must be seated next to or directly behind the learner driver.
In addition should the vehicle require the driver to have a professional driving permit PrDP (e.g. heavy load vehicle, heavy passenger vehicle, a minibus designed to carry more than 12 persons including the driver or a breakdown vehicle) the licensed driver must be in possession of a valid PrDP.

Yes - as long as the person seated next to or directly behind holds a valid driver's licence for the class of vehicle concerned (this may include a licence of a vehicle category higher than the vehicle being driven) and has the necessary PrDP as may be required.
The learner driver may not transport passengers on a motorcycle.

Yes, provided that the a licensed driver for the same class of vehicle is seated either next to or behind the learner driver.
Regulation 99 (2) (a) only states that the passengers may not be conveyed for reward.
(2)(a)
The holder of a learner's license shall, except where
such license relates to a motor vehicle having no seating accommodation for a passenger or to a motor cycle, when driving the vehicle concerned, be accompanied in or on that vehicle by, and be under the direct personal supervision of a person seated next to him or her, or immediately behind him or her, where such person cannot be seated next to him or her, and who is in possession of a license, other than a learner's or similar license, authorizing him or her to drive that class of motor vehicle.
(b)
A learner's license in respect of a motor cycle shall not
authorize the holder of it to drive a motor cycle on a public road while carrying another person.
(c)
A learner's license shall not authorize the driving of a motor
vehicle while carrying persons for reward, other than a person accompanying the holder of a learner's license in terms of paragraph (a).
